1. What DriveHaus is
DriveHaus is an online marketplace that lets people in the Philippines advertise vehicles for sale and contact each other about them. We are not a dealer, broker, agent, escrow service or financier. We do not own, inspect on our own account, warrant, insure, deliver or take payment for any vehicle listed on the platform. Every sale is a private contract between the buyer and the seller.
2. Who may use it
You must be at least 18 years old and legally able to enter into a contract. You must give accurate registration details and keep them current. One person may hold one account; accounts may not be shared, sold or transferred. We may refuse, suspend or close an account at our discretion, including where the account is used for fraud, misrepresentation or abuse of other users.
3. Verification levels
Level 1 means the email address and mobile number on the account have been confirmed by a one-time code. Level 2 means a government-issued identity document and a selfie have been submitted and reviewed by our team. Verification is a check of documents supplied to us; it is not a guarantee of a person's honesty, solvency, or ownership of any vehicle. You must reach Level 1 to message sellers or make offers, and Level 2 to publish a listing.
4. Listings
Sellers are solely responsible for their listings. By publishing one you confirm that you own the vehicle or are authorised to sell it, that the photographs are of that vehicle and taken by you or with permission, and that the description, mileage, condition and papers status are accurate to the best of your knowledge. You may not list a vehicle that is stolen, subject to an undisclosed encumbrance, or that you cannot lawfully transfer.
We review listings before they are published. Review is a basic check for obvious problems and is not an inspection, valuation, or confirmation of ownership or roadworthiness. We may reject, edit, pause or remove any listing, and may feature listings at our discretion.
5. Messages and offers
Messages and offers exchanged on DriveHaus are stored and may be reviewed by our team when investigating a report or dispute. An accepted offer records the price the parties agreed; it is not, by itself, a contract of sale and does not oblige either party to complete. Do not send money, personal identity documents or one-time passcodes through chat.
6. Fees and invoices
Buying is free. Listing is free. When a seller marks a vehicle as sold to a buyer introduced through DriveHaus, a success fee becomes payable, calculated as a percentage of the sale price at the rate published on the platform at the time of the sale. Where a seller requests an independent inspection, the inspection fee published at the time of the request becomes payable when the report is published.
Invoices are payable by the due date shown. Payment is made to the account details shown on the invoice, and the seller records the payment reference on the platform for confirmation. Unpaid invoices past their due date may prevent new listings being published. We may suspend an account with persistently unpaid invoices. Fees are exclusive of any taxes that may apply.
Deliberately misreporting a DriveHaus sale as a sale made elsewhere, in order to avoid the success fee, is a breach of these terms and may result in the account being closed and the fee being pursued as a debt.
7. Inspections
Inspections are carried out by independent mechanics engaged through DriveHaus. A report records the mechanic's opinion of the vehicle's condition on the day of the inspection, based on a visual and functional check without dismantling. It is not a warranty or a guarantee of future condition, and it does not replace your own inspection or a mechanic of your choosing. Mechanics may not offer repair work on a vehicle they inspect through the platform.
8. Reviews
Only a buyer recorded as the buyer of a completed sale may review the seller of that sale. Reviews must be honest and relate to the transaction. We may remove reviews that are abusive, contain personal data, or are not from a genuine transaction. A seller may publish one reply to each review.
9. Prohibited conduct
- Listing a vehicle you do not own or may not lawfully sell
- Misrepresenting mileage, accident or flood history, or the status of the OR/CR
- Asking for a deposit to "hold" a vehicle before the buyer has seen it
- Publishing contact details in a listing in order to move buyers off the platform before a viewing
- Harassment, discrimination, threats, or abusive messages
- Scraping, bulk-downloading, or automated access without our written permission
- Attempting to interfere with the security or operation of the platform
10. Content you provide
You keep ownership of the photographs and text you upload. You grant DriveHaus a non-exclusive, royalty-free licence to host, display, resize and distribute that content for the purpose of operating and promoting the platform. You are responsible for having the right to grant that licence.
11. Suspension and closure
We may suspend or close an account, and remove listings, where we reasonably believe these terms have been breached, where a report is being investigated, or where required by law. You may deactivate your account at any time from your settings; records of completed sales, invoices and disputes are retained as described in the Privacy Policy.
12. Liability
DriveHaus provides the platform on an "as is" basis. To the fullest extent permitted by Philippine law, we are not liable for the condition, legality, safety or description of any vehicle, for the conduct of any user, for any transaction between users, or for indirect or consequential loss. Nothing in these terms limits liability that cannot lawfully be limited. Where liability cannot be excluded, it is limited to the fees you paid to DriveHaus in the twelve months before the claim.
13. Disputes between users
Disputes about a vehicle or a sale are between the buyer and the seller. We will, on request, provide the parties with the record of their messages and offers and may act on reports by removing listings or suspending accounts. We do not adjudicate, refund, or compensate.
14. Changes
We may update these terms. Material changes will be notified through the platform. Continuing to use DriveHaus after a change means you accept the updated terms. The fee rate applying to a sale is the rate published when the vehicle is marked sold.
15. Governing law
These terms are governed by the laws of the Republic of the Philippines. The courts of the Philippines have exclusive jurisdiction over any dispute arising from them.
